Legal aspects of the relation between landscape architecture and environmental protection

Abstract. The article contains discussion of theoretical concepts and general regulations definition of environmental protection and landscape. They have been described on constitutional basis of the environmental protection law especially balanced development rule as the rule which has a fundamental influence on the landscape shape. Also functions of the law within the appropriate environmental protection and rational forming of landscape have been discussed. The authors have also focused on the indication of factory concerning obligatory regulations corresponding to the problems of legal environmental protection alongside with the principles forming the landscape. Attempt to estimate the influence of the above-mentioned factors has been taken on rational landscape forming and mutual conditionality among forceful environmental protection but rational forming of landscape. Analysis performed by authors and solutions accepted take into consideration at national explanation of regulations and within the confines of the European Union. The authors take into account the jurisdiction of general courts also Constitutional Tribunal and literature and views of doctrines in objective range.
